What You Should Know About Vicious Dog Laws

Although the verbiage in various vicious dog laws tends to vary, basically they are all in place for the same reason; in an effort to try to protect the general public from vicious dogs that have been known to attack humans when unprovoked. How stringent these dog laws are depends on you actually, for if you seek to have stronger dog laws, it behooves you to have rallied for more stringent laws.

 

In almost every state, the machinations of their dog laws are basically the same. First, a complaint needs to be received, either from someone who has sustained a dog bite or perhaps by animal control officers. Next, a hearing is scheduled. Whoever acts as judge or enforcing officer of the district will decide if the case warrants further investigation or if the dog is judged to be a dangerous dog. In many states such a judgment is cause for the animal to be destroyed, but that sort of instantaneous judgment is extremely rare. Instead, in some jurisdictions, the dog owner is going to be watched extremely carefully to be sure that the owner pursues the directives set by the court, such as fencing in the offensive dog or having to use an especially strong leash on the dog. 

 

Also, in practically every state, there are exceptions to their dog laws. These include the brave police dogs that are acting under their training and their very able trainers. Other dogs are also excluded from vicious dog laws, such as those who partake in FBI work, for instance.

 

Some states have enacted extremely stringent dog laws so that there are practically no loopholes or deviations in their laws. Some, however, are written in a vague manner; enabling almost any dog owner to circumvent the law one way or another. Thus attorneys frequently will fight for their clients, whereas in another state the case would never be fought and the dog owner would quickly capitulate. It appears that the state of Vermont is one of the most difficult for someone to win a case against a vicious dog owner, all due to their vicious dog laws and how they are written.

 

Some areas have tried to control dog owners by unfortunately penalizing those who take excellent care of their dogs and own dogs that surely would never ever be considered a menace. This includes such things as ensuring that every dog owner has microchipped their dogs so that identification of the owner is instantaneous should a problem occur with a particular dog. Another means was passed saying that anyone who owned a dog had to be insured in case the dog bit, maimed or killed someone.
