Dog Bites Laws: Being Aware Is The First Step Towards Responsibility

Dog bites laws are in place here in the United States to protect our citizens from dogs that viciously attack for no known reason. Though these laws vary by state, city, or jurisdiction, there are many similarities. For instance, in most cases, if an owner fails to properly restrain the dog, by fencing, leashing, or other means, then the owner may be found negligent and responsible for any damages incurred due to the attack.

On the other hand, there are also a very specific set of dog bites laws in place in several states across the nation that protect the well being of dogs and other animals. Many of these laws specifically outline a provoked attack to be no fault of the dog or due to any negligence on the part of the owner.

Of course, there are many states that have failed to update their dog bites laws accordingly, and this leaves these laws open to scrutiny in the courtroom. For instance, improperly worded statutes, amendments, and the like tend to allow others to bend these laws to their favor. This is usually where an attorney is helpful.

Dog owners are protected and prosecuted by these laws as well, as they are ultimately responsible for the care of their pet, as well as any damage that it may cause throughout the course of its lifetime. Many a dog owner has opened themselves up to lawsuits, criminal prosecution, and steep fines when they have failed to act responsibly during the course of caring for their pet and ensuring its protection as well as the protection of the public from it.

Though a dog or dog owner may not always be at fault when an attack occurs, the entire situation must be presented to the court or the investigating officer in order to determine the best recourse. Situations of abuse, neglect, or failure to properly train a dog may be brought up during this presentation. Of course, any wrongdoing on the part of the victim of the attack will also be considered and thoroughly discussed. The determination of which party is responsible will be decided and the guilty party will be responsible for any damages.

Dog bites laws are in place to protect everyone and any responsible pet owner should ensure that they are well aware of these laws so that they can make absolutely certain that they uphold them. This is the best way to protect yourself and your pet from future legal issues.
